Welcome to Unpolished Designs Co. By accessing or using our website and Etsy shop, you agree to comply with and be bound by the following terms and conditions ("Terms of Service", "Terms"). Please read these terms carefully before using our services.

General Conditions

  • We reserve the right to refuse service to anyone for any reason at any time.
  • You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
  • You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

Products and Services

  • Accuracy of Information: We strive to provide accurate information about our products and services. However, we do not warrant that the product descriptions, pricing, or other content on our website or Etsy shop is accurate, complete, reliable, current, or error-free.
  • Modifications to Services and Prices: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

Orders and Payments

  • Order Acceptance: We reserve the right to refuse any order you place with us. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.
  • Payment: All payments are processed securely through Etsy's payment system. We accept Etsy Gift Cards and Etsy Credits. Etsy keeps your payment information secure and never shares your credit card information with us.

Shipping and Delivery

  • Processing Time: Orders are processed within 1-2 business days. Shipping times may vary based on location and shipping method chosen at checkout.
  • Shipping Costs: Shipping costs are calculated based on the destination and shipping method selected. Buyers are responsible for any customs and import taxes that may apply. We are not responsible for delays due to customs.

Returns and Exchanges

  • Personalized Items: Returns are not accepted for personalized items. If there is an issue or damage with your product, please contact us within 7 days of receiving your order for a replacement.
  • Non-Personalized Items: Returns are accepted within 14 days of delivery for non-personalized items. Items must be in their original condition and packaging. Buyer is responsible for return shipping costs.
  • Exchanges: Accepted within 14 days of delivery for non-personalized apparel. Items must be unworn, unwashed, and in their original condition with tags attached. Buyer is responsible for return shipping costs.
  • Replacement: If your item arrives damaged or there is a quality issue, we will replace the item at no additional cost. Please provide photos of the damaged item and packaging for assessment.
  • Refunds: Not offered except in cases where a replacement item is not available or for non-personalized items that are returned within the specified period.

Limitation of Liability

  • To the fullest extent permitted by applicable law, Unpolished Designs Co. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

Indemnification

  • You agree to indemnify, defend, and hold harmless Unpolished Designs Co. and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees, from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

  • We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and changes to our website and Etsy shop. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
